Terms and Conditions

These Terms and Conditions (the “Terms”) apply to the Foam Fiesta™ website, booking requests, services, equipment rentals and events. Foam Fiesta™ is an operating name of J.S. Productions – Electronic Music Events Inc. (“Foam Fiesta,” “we,” “us” or “our”). By using this website, submitting a booking request, paying a deposit or accepting services from us, you agree to these Terms.

1. Booking Requests and Confirmation

Submitting an online form is a booking request only and does not guarantee availability or confirm a reservation. A booking is confirmed only after Foam Fiesta has accepted the request, issued confirmation or an invoice, and received the required deposit.

After we contact you, the deposit must be paid within seven (7) days. If the deposit is not received within that period, or if we cannot reach you within seven (7) days after receiving your request, the requested date may be released without further notice.

The person making the booking confirms that they are at least 19 years old and authorized to enter into the booking on behalf of the customer, organization or event host.

2. Prices, Taxes, Travel and Payment

All prices are in Canadian dollars and are subject to applicable taxes. Website prices and package descriptions may change, but confirmed bookings will be governed by the accepted quote or invoice.

Free delivery applies within the Greater Moncton area where expressly included. Events outside that area are generally subject to a travel fee of $1.25 per kilometre, calculated round trip from our location. Longer-distance events may also require accommodations, additional staffing or minimum booking amounts, which will be disclosed in the quote.

Unless otherwise stated in writing, the deposit is approximately 30% of the booking total and the remaining balance is due upon delivery or before the service begins. We accept the payment methods communicated on the invoice or booking confirmation. Any applicable credit-card processing surcharge will be disclosed before payment.

3. Cancellation and Rescheduling

Foam Blaster 1, Foam-To-Go 1 and 2, and Bubble Party Packages

Customers may cancel and receive a full refund of the deposit when cancellation is received at least 48 hours before the scheduled event. For cancellations made within 48 hours of the event, the deposit is non-refundable but may be transferred to another available date within the same operating season.

Foam Blaster 2 and Mega Cannon Packages

Customers may cancel and receive a full refund of the deposit when cancellation is received at least 30 days before the scheduled event. For cancellations made within 30 days of the event, the deposit is non-refundable but may be transferred to another available date within the same operating season.

Customers must provide at least 24 hours’ notice of cancellation. Failure to provide that notice may result in additional charges, up to the full outstanding booking balance, where staffing, travel, equipment preparation, solution preparation or other non-recoverable costs have already been incurred.

Rescheduled dates are subject to availability. Any rescheduling credit must be used within the applicable operating season unless Foam Fiesta agrees otherwise in writing.

4. Weather and Outdoor Conditions

Foam events can generally proceed in ordinary rain because participants will already get wet. The customer is responsible for monitoring weather forecasts and deciding whether to cancel or reschedule within the applicable cancellation period.

Foam Fiesta may delay, modify, suspend or cancel an event when lightning, severe weather, unsafe winds, flooding, fire restrictions, poor site conditions or another circumstance creates an unreasonable safety risk or prevents proper operation.

When Foam Fiesta cancels an event for safety or operational reasons, we will first attempt to reschedule it. If a mutually acceptable replacement date cannot be arranged, amounts paid for services not provided will be refunded.

Foam Fiesta is not responsible for indirect costs such as venue charges, catering, advertising, travel or other third-party expenses.

5. Customer and Venue Responsibilities

The customer must:

  • Obtain all venue permissions, permits and approvals required for the event.
  • Provide safe, timely and unobstructed access for delivery, setup and removal.
  • Provide a reasonably flat, stable and drainable outdoor area that is clear of hazards, vehicles, fragile items and sensitive equipment.
  • Provide the dedicated electrical circuits, grounded outlets and water access specified for the selected package, generally within 100 feet of the setup area.
  • Identify underground irrigation, electrical systems, septic components and other concealed hazards before setup.
  • Ensure that the venue permits the expected water and foam use.
  • Provide accurate attendance, venue and event information.

If the required access, power, water, permissions or site conditions are not available at the scheduled time, Foam Fiesta may reduce, delay or be unable to provide the service. Payments may remain due where the failure results from conditions within the customer’s control.

6. Participant Safety and Supervision

Foam and wet surfaces can be slippery. Participation is voluntary, and all participants must follow posted rules and instructions from Foam Fiesta staff or the event organizer.

Rough play, climbing on equipment, entering restricted setup areas and deliberately directing foam toward another person’s face are prohibited.

Children must be actively supervised by responsible adults designated by the customer or event organizer. Foam Fiesta staff operate the entertainment equipment but do not provide childcare, lifeguarding or general crowd supervision unless expressly agreed in writing.

Participants should wear suitable clothing and secure, non-slip footwear or water shoes. Anyone with allergies, skin sensitivities, respiratory concerns or another medical condition should obtain appropriate advice before participating and stop immediately if irritation or discomfort occurs. Foam solution must not be swallowed.

Our standard foam solution is water-based and selected for entertainment use. Individual sensitivities and site-specific effects can vary.

Colour and glow additives may temporarily mark or stain clothing, footwear, hair, porous materials or other surfaces. Participants should wear clothing they do not mind getting wet or potentially stained.

7. Self-Operated Packages and Equipment Rentals

For self-operated and pickup packages, the customer must ensure that only a responsible adult operates the equipment and that all operating, electrical, water, setup and safety instructions are followed.

Equipment must not be altered, moved from the approved setup, opened, repaired, submerged, overloaded or used for any purpose other than its intended use.

The customer is responsible for the equipment from delivery or pickup until it is returned to or collected by Foam Fiesta, excluding ordinary wear and damage caused by an inherent equipment defect.

The customer may be charged for loss, theft, abnormal cleaning, misuse or damage occurring during that period. Equipment must be returned at the agreed time and in substantially the same condition in which it was supplied.

8. Service Estimates and Equipment Substitutions

Participant capacities, foam reach, coverage, output and operating times shown on the website are reasonable estimates rather than guarantees.

Actual results may vary because of wind, temperature, water pressure, water quality, electrical supply, terrain, crowd behaviour and other site conditions.

Foam Fiesta may substitute equipment or adjust a setup when reasonably necessary, provided the substitute or revised setup offers substantially comparable functionality. Music, lighting and promotional add-ons are subject to availability and venue rules.

9. Property and Personal Belongings

The customer should remove or protect electronics, furniture, decorations, vehicles and other items that may be affected by water, foam, wind or participant activity.

Foam Fiesta is not responsible for unattended personal belongings or damage arising from undisclosed hazards, unsuitable venue conditions, failure to follow instructions, or the ordinary and expected effects of an outdoor water-based activity.

10. Limitation of Liability

To the fullest extent permitted by law, Foam Fiesta will not be liable for indirect, incidental, special or consequential losses arising from use of the website, cancellation of an event, participation in an activity or use of rented equipment.

Where liability cannot lawfully be excluded, Foam Fiesta’s liability will be limited to the amount paid for the affected booking, except where a different remedy is required by applicable law.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability arising from gross negligence or wilful misconduct where applicable.

11. Website Information and Third-Party Services

We make reasonable efforts to keep website information accurate and current. Photographs and videos are illustrative, and actual equipment, setup, output and event conditions may vary.

We may correct errors and update prices, packages or website content at any time.

Our website may contain links, embedded content or services operated by third parties. Foam Fiesta does not control and is not responsible for third-party websites, platforms, payment processors or their respective terms and privacy practices.

12. Intellectual Property

The Foam Fiesta™ name and logo, website design, written content, graphics, photographs, videos, package names and promotional materials are owned by or licensed to J.S. Productions – Electronic Music Events Inc.

They may not be copied, reproduced, modified, republished, distributed, scraped, displayed, used in advertising or presented as another business’s content without prior written permission.

No licence or ownership interest is granted by accessing the website. “Foam Fiesta” and the Foam Fiesta logo are the subject of Canadian trademark applications. The ™ symbol identifies claimed trademark rights and does not represent that registration has already been granted.

13. Privacy

Personal information submitted through the website or during a booking is handled in accordance with our Privacy Policy.

By providing contact information, you authorize us to communicate with you about your inquiry, booking, payment and event.

14. Governing Law

These Terms are governed by the laws of the Province of New Brunswick and the applicable federal laws of Canada.

Any dispute will be subject to the jurisdiction of the courts of New Brunswick, unless applicable consumer-protection law requires otherwise.

15. Changes and Severability

We may update these Terms from time to time by posting a revised version and changing the “Last updated” date.

The Terms in effect when a booking is confirmed will apply to that booking unless the parties agree otherwise in writing.

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect. A failure to enforce a provision does not waive the right to enforce it later.
